MINUTES OF NASHVILLE VILLAGE COUNCIL MEETING

HELD SEPTEMBER 27, 2007

Nashville Village Council Regular session was called to order by President Frank Dunham on September 27, 2007 at 7:00 p.m. in the council chambers.

PLEDGE OF ALLEGIANCE

ROLL CALL
Present were: Mary Coll, Richard Harwood, Frank Dunham, and James Dunham
Absent: Mike Kenyon, Jack Holden, and one open seat

AGENDA
Add – Betty and Kendall Wilcox fence request; DNR Grant for river restoration; Carol Tobias – paint removal request

Motion Coll seconded by J Dunham to accept the agenda for September 27, 2007 as amended. Ayes – Coll, J Dunham, Harwood, and F Dunham. Nays – none. Absent – Kenyon, Holden, and one open seat. Motion approved.

MINUTES
Motion by Coll seconded by J Dunham to approve the minutes of the Regular Meeting held September 9, 2007 as presented. Ayes – J Dunham, Harwood, Coll, and F Dunham. Nays – none. Absent – Kenyon, Holden, and one open seat. Motion approved.

COMMUNICATIONS
A meeting for Village Businesses will be held on October 8, 2007 at 7 am at The Gardens.

AUDIENCE QUESTIONS - none

DANS APPLIANCE OUT DOOR SALES REQUEST
Dropped due to lack of attendance of owner per request by council

POLICY REVISION
Motion by J Dunham seconded by Coll to approve the revision of the Policy Regulating Costs as presented. Ayes –Harwood, Coll, J Dunham, and F Dunham. Nays – none. Absent – Kenyon, Holden, and one open seat. Motion approved.

PARKING LICENSE REQUEST FORMS
Discussion – would like to add the wording “good for only one year from date of issue” in the 4th paragraph for clarification to the applicant.

Motion by Coll seconded by J Dunham to approve the parking license request form as amended. Ayes – Coll, J Dunham, Harwood, and F Dunham. Nays – none. Absent – Kenyon, Holden, and one open seat. Motion approved.

WILCOX FENCE REQUEST
Mr. Wilcox – asked by the zoning administrator to remove a fence on their property that has been there for over 30 years (a newer version of the fence was placed about 5 years ago) This was before the zoning ordinance or the right-of-way ordinance were in effect. Asking that the fence be grandfathered in and they be allowed to keep it as is.

Motion to table the Wilcox fence issue until the next meeting so that the council can talk to the DPW and Police Chief to find out if they have any problems with the fence staying. Ayes – J Dunham, Harwood, Coll, and F Dunham. Nays – none. Absent – Kenyon, Holden, and one open seat. Motion approved.

DNR GRANT
Discussion – Pres. Dunham read information received from DNR on a grant they would like to submit paperwork for that would help pay for the removal of the dam on Thornapple River within the village limits. This grant is a partnered project that includes Barry Conservation District, Thornapple Grand Conservation District, Barry County Drain Commissioner, and the Eaton County Drain Commissioner. The council does not have to accept the grant if in the future they decide that the village cannot meet the match on funds or change their mind about removal of the dam. It is just an initial grant proposal request and it must be placed by September 28 (tomorrow) to gain entrance for consideration.

Motion by J Dunham seconded by Coll to allow the Village of Nashville to be named as a supporting partner in the Thornapple River Restoration/ Nashville Dam Removal project to be submitted by the DNR. Ayes –Harwood, Coll, J Dunham, and F Dunham. Nays – none. Absent – Kenyon, Holden, and one open seat. Motion approved.

PAINT ON CAR COMPLAINT
Discussion – Mrs. Tobias has requested that the village pay for the removal of yellow paint that was splashed onto her car after she drove through a newly painted yellow line on Reed Street. The incident occurred while Mrs. Tobias drove around the village truck, on the left hand side, who where in the middle of Reed Street painting the center line. (One man was in front painting with a truck behind with blinkers on which was going about 2 mpr, cones were in place behind the truck, and there was room on both side of the vehicle for cars to pass - on the right hand side - without going over the yellow line) Council does not feel that the village is responsible for this incident. The DPW took all the precautions needed and Mrs. Tobias did not have to cross the yellow line to pass the men working, there was room on the right hand side to pass, which would have been the correct way to go around this work crew. (Shortly after Mrs. Tobias went around the crew on the left side, the village police chief went around the work crew on the right side without a problem)

Motion by J Dunham seconded by Coll to decline responsibility of any wrong doing by the Village of Nashville in the incident involving Mrs. Tobias’s car being splattered by yellow paint. Ayes – Coll, J Dunham, Harwood, and F Dunham. Nays – none. Absent – Kenyon, Holden, and one open seat. Motion approved

COMMITTEE REPORTS
DPW – will be meeting on October 10, 2007 at 7 pm; Bore sampling has been done on Mr. Beebe property – still awaiting the results

ROUNDTABLE
Harwood – will be attending the seminar for beginning trustees – core weekender – on October 19 & 20
F Dunham – encouraged other trustees to attend this meeting with Harwood – need to let the clerk know soon it they would be able to attend.

Motion by Coll seconded by J Dunham to adjourn at 8:00 pm. All ayes. Motion carried
