Approval of a land division is required before it is created or transferred to another party. This form is designed to assist the applicant to comply with applicable local zoning, land division ordinances and Section 109 of the Michigan Land Division Act (formerly the Subdivision Control Act. P. A. 288 of 1967, as amended (particularly by P. A. 591 of 1996), MCL 560.101 et.seq.)

5. ATTACHMENTS (all attachments must be included)

A. Survey(s) for each resulting parcel, prepared by a registered land surveyor, to include:
____ dimensions of each resulting parcel, including all parcels to be retained by the owner
____ legal description of each resulting parcel, including all parcels to be retained by the owner
____ location and legal description of existing and proposed road/easement right of ways
____ easements for public utilities from each parcel to existing public utility facilities
____ drawings of any existing improvements (buildings, wells, septic system, driveways, etc) and their location with respect to proposed lot lines
____ location of all natural or man-made water courses including lakes, rivers, ponds, creeks, drains, etc.

B. Indication of approval, or permit from the Village and/or MDOT for each proposed new road, easement or shared driveway.

C. For each proposed private road, a copy of road specifications as required by the Village zoning ordinance.

D. A copy of any transferred division rights which clearly identifies the number of division rights that each resulting parcel is receiving. If no division rights are being transferred, then a written statement to this effect must be prepared and submitted.

E. The fee for processing this application is $200 for division which results in less than 5 parcels. For each resulting parcel after 4 parcels, the fee is an additional $25 per parcel.

F. History of prior land divisions – title search provided may be necessary.

6. AFFIDAVIT and permission for permission for municipal, county and state officials to enter the property for inspections:

I agree the statements made above are true, and if found not to be true this application and any approval will be void. Further, I agree to comply with the conditions and regulations provided with this parent parcel or parent tract division. Further, I agree to give permission for officials of the municipality, county, and State of Michigan to enter the property where this parcel or tract division is proposed for purposes of inspection to verify that the information on the application is correct at a time mutually agreed with the applicant. Finally, I understand that any permit hereunder only constitutes approval to create a land division pursuant to the State Land Division Act (formerly the Subdivision Control Act, P. A. 288 of 1967, as amended (particularly by P. A. 591 of 1996), MCL 560.101 el.seq.), and does not provide, constitute, infer or imply use of zoning approval of any such division, easement or resulting parcels or constitute, infer or imply build ability or compliance with any other applicable statue, law, building code, deed restriction or property right.

Finally, even if this division is approved, I understand zoning, local ordinances, and State Acts change from time to time, and if changed the divisions made here must comply with the new requirements (i.e., apply for division approval again) – see the Nashville Land Division Ordinance for time limitations.
